Why work with us?

Three simple principles that efficient legal work cannot do without.

Preparing the documents of a property transaction

Speed

We respond to every enquiry within 24 hours. We typically prepare the sale and purchase agreement within 2–3 business days and offer a signing appointment at our office at short notice. With us, nothing is left waiting.

Reviewing legal documents together

Reliability

We cover the entire property transaction: we obtain all required documents, draft and countersign the agreement, file the notification with the tax authority, represent you before the land registry, and help optimise the transfer duty. We keep your interests in focus – from the very first step to the final registration of ownership.

Handshake closing a successful property transaction

Efficiency

We are in regular contact with land registries and banks and know their requirements well – whether it is a mortgage loan, CSOK Plus, the new 3% Otthon Start Programme or any other subsidy. With us, legal matters are handled not only quickly but seamlessly.

The property sale and purchase process

  1. Contacting the law office

By phone, by e-mail or through our online form.

  2. Initial consultation and legal guidance

We discuss the details of the transaction and explain the legal process and the documents required.

  3. Checking the title deed and the property

We request and review the property’s title deed and identify any encumbrances or legal obstacles.

  4. Preparing the agreement

We draft the sale and purchase agreement, taking into account the parties’ arrangements and the legal requirements.

  5. Signing and countersigning the agreement

The parties sign the agreement, which our lawyer countersigns to ensure its legal validity.

  6. Payment of the purchase price

The buyer pays the purchase price in the manner and within the deadline set out in the agreement.

  7. Initiating land registry registration

Our lawyer submits the required documents to the land registry to register the transfer of ownership.

  8. Handover of possession

Possession of the property is handed over and recorded in a protocol, including meter readings and any remarks.

  9. Final registration of ownership

The land registry registers the buyer’s ownership and sends an official notification.

In certain cases, a property transaction may differ from the standard process, for example:

  1. CSOK Plus / Baby loan / Otthon Start Programme / other bank loan

Special contractual conditions and formal requirements.

  2. Encumbered property

A mortgage or other right must be settled before the transfer.

  3. Preliminary agreement

When the parties are not yet ready to sign the final agreement.

  4. Payment in instalments

The conditions for transferring ownership must be set out on a schedule.

  5. Right of pre-emption

A third party’s entitlement may change the course of the sale.

When our office drafts your sale and purchase agreement, we make sure that it always reflects the individual circumstances and legal needs of the contracting parties.

Is a lawyer required for a property sale and purchase agreement?

Yes. In Hungary, a property sale and purchase agreement must be countersigned by a lawyer to be valid. The lawyer ensures that the agreement complies with the law and represents the interests of the parties.

Which documents are needed for the sale and purchase agreement?

The identity documents of the seller and the buyer, the title deed of the property, an energy performance certificate, the deed of foundation of the condominium (for condominium flats) and, if a loan is taken out, the documents required by the bank.

What is the difference between a deposit (foglaló) and an advance payment (előleg)?

A deposit secures the agreement: if the sale falls through due to the buyer’s fault, the buyer loses the deposit; if it is the seller’s fault, the seller must repay double the amount. An advance payment, however, is always refunded if the sale falls through.

What is an energy performance certificate and when is it required?

An energy performance certificate documents the energy efficiency of a property and is mandatory when selling a property. It must be obtained by the seller and is valid for 10 years.

What costs should I expect when buying a property?

In addition to the purchase price, the buyer should budget for the lawyer’s fee, the land registry procedural fee, the property transfer duty (usually 4% of the purchase price) and, if applicable, the costs related to a loan.

When is the property transfer duty payable?

The duty is payable after the registration of the sale and purchase agreement, based on the tax authority’s decision. The obligation to pay usually lies with the buyer.

What happens if the property is encumbered (e.g. by a mortgage)?

If the property is encumbered by a mortgage or another charge, it must be settled during the sale. The lawyer assists with the release process and ensures that the buyer acquires an unencumbered property.
